How to cost your labor contract, 2d ed.

Granof, Michael H. et al.
BNA Books, ©2011    229 p.    $145.00    HD4909
978-1-57018-928-9

This second edition is the first to come out in 40 years. The original author, Granof (business, U. Texas, Austin), is joined by Grenig (law, Marquette U.) and Kelly (dispute resolution, Marquette U.). It is an outline that argues why you should cost your labor contract, how to strategize your costing approach, how to implement that strategy in labor negotiations, and how arbitrators view cost in their decision-making. It is written from an employer's perspective with an emphasis on accountants and financial professionals in addition to human resources officers in calculating the costs of human capital, but would also be useful for union representatives charged with costing collective bargaining agreements. The first part focuses on analysis and preparation, including how to prepare a costing worksheet and how to evaluate wages and other contract provisions. The second part is concerned with execution, including costing during negotiations, using an interest-based negotiation style, using alternative dispute resolution, and using costing information in arbitration. A modest amount of arithmetic is involved. While there is no bibliography, ample foot-notes contain citations where relevant. (Annotation ©2011 Book News Inc. Portland, OR)

Patents and the Federal Circuit, 10th ed.

Harmon, Robert L. et al.
BNA Books, ©2011    1674 p.    $640.00    KF3114
978-1-57018-971-5

Robert L. Harmon (1938-2010) authored the first edition in 1987; the volume consisted of the shaped results of a database he had compiled for his intellectual property firm in response to the need for ready access to decisions made by the Court of Appeals for the Federal Circuit. Cynthia A. Homan and Charles M. McMahon, colleagues at his Chicago firm, worked with Mr. Harmon before his passing, to incorporate the 2010 Supplement and all new patent case law from the Federal Circuit into the previous edition in order to create this tenth edition. Coverage encompasses all Federal Circuit patent opinions reported by BNA in United States Patents Quarterly that were issued by the court through the end of 2010. (Annotation ©2011 Book News Inc. Patent litigation strategies handbook, 3d ed.

Ed. by Barry L. Grossman and Gary M. Hoffman.
BNA Books, ©2010    1655 p.    $435.00    KF3155
978-1-57018-886-2

Members of the American Bar Association Section of Intellectual Property Law collaborated to create this text — an ongoing effort to provide an up-to-date resource for litigators and attorneys. This third edition, published ten years after the first, incorporates updates, of course, but also features a new perspective from a judge's point of view, offering practical tips for conducting an effective patent trial. Material is arranged chronologically, from opening moves, discovery, and motion practice to the trial presentation, and appeals. Annual cumulative supplements are published to track statutory, regulatory, and case law developments. (Annotation ©2011 Book News Inc. Portland, OR)

The Pregnancy Discrimination Act; a guide for plaintiff employment lawyers.

Williams, P. Daniel.
BNA Books, ©2011    731 p.    $295.00    KF3467
978-1-57018-861-9

Williams (founding partner of a Jacksonville, Florida firm specializing in labor and employment law) has prepared this guide to help plaintiff lawyers "...advance the cause of women who wish to start a family without ending a career...," as he states in the preface. The 1978 Pregnancy Discrimination Act (PDA) spelled out that it is unlawful to discriminate based on pregnancy or related medical conditions, and in recent years employment lawyers have seen such cases become an increasingly large portion of their work. This guide provides strategic suggestions, case law, and legal analysis and will be useful not only to plaintiff lawyers but also to lawyers advising employers who seek to comply with the law.
