Compensation for environmental damages under international law; the role of the international judge.
Investigating international dispute adjudication mechanisms in regard to environmental damages, Reis (PhD, international law, U. de Lausanne, Switzerland) seeks to develop a new criterion for the determination of compensation such that international responsibility results in an efficient mechanism coherent with the contemporary approach of environmental protection. Analyzing treaties, international decisions, and secondary sources, he argues that some elements of international law allow the adjudicator to adapt the compensation to attend to certain environmental interests, rather than strict reparation of material losses, thereby creating a new "fair compensation" approach that is the most effective means of conciliating international responsibility and environmental interests. Confidentiality in international commercial arbitration.
"Few legal concepts in international arbitration are more indefinite in nature, dubious in scope and uncertain in inexistence than confidentiality," which lacks "conceptual uniformity and shows clear limitations," according to the author of this volume, who seeks to bring greater coherence to the issue through an analysis of the concept of confidentiality as reflected by the most important arbitration rules, national laws, other arbitration-related enactments, and practices of arbitral tribunals and domestic courts around the world. Five chapters define the concept and distinguish it from the concept of privacy, analyze confidentiality as a contractual creation that is only sporadically accepted as an implied matter, review the scope of confidentiality in arbitral practice, identify the main categories of persons bound by confidentiality of arbitration, and assess a system of measures aimed at protecting confidentiality and sanctioning confidentiality breaches in arbitration. The derivatives revolution; a trapped innovation and a blueprint for regulatory reform.
With financial derivatives now seen as having played a key part of the 2008 global financial melt-down, as well as in earlier financial scandals such as Enron, this volume analyzes a federal regulatory approach to disciplining the use of derivatives by corporations in order to prevent excessive risk taking, the emergence of rogue traders, and the creation of systemic disturbances caused by chains of derivatives-related losses. The approach presented is an activity-based regulatory approach, as opposed to the current rule- and entity-based approach. It seeks to improve the disclosure paradigm governing non-banking reporting issuers in order to discipline derivatives risk trading; encourage and incentivize the use of market-like mechanisms to automate trading, back-office checks, and the creation of derivatives documentation; and develop specific corporate governance policies to ensure full awareness of levels of risk and potential consequences of derivatives trading.
