Slobogin (criminal justice, Vanderbilt U.) and Fondacaro (psychology, John Jay College of Criminal Justice) advocate for a preventative model of juvenile justice which keeps youths out of the adult court system and adopts modern risk-management techniques to avoid recidivism. After providing a brief history of the juvenile court and the four predominating modes of juvenile justice in America, they outline current research on the causes of juvenile crime, differences from causes of adult crime, and potential methods for reducing youth recidivism; contrast the role and efficacy of a retributive model of correction with an individual prevention model, particularly in juvenile cases; and detail the practical application of a preventative model which would be administrative rather than criminal in nature, and prohibit transfer of juveniles into the adult correction system. They argue that research does not support the use of adult models in youth correction, and consider avenues to influence policymakers to adopt new methods based on fiscal, crime prevention, and therapeutic benefits.
